By accessing or using Afzil (the "Service") operated by Afzil ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Afzil provides OTP (One-Time Password) verification services via email and SMS channels. The Service includes API access, dashboard management, analytics, and related features.
3. Account Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited messages (spam)
- Harass, abuse, or harm another person
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit malware or engage in phishing
- Attempt to gain unauthorized access to systems
- Interfere with or disrupt the Service
5. Rate Limits and Usage
The Service is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary suspension of service or additional charges.
6. Fees and Payment
Fees are based on your selected subscription plan and usage. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
We reserve the right to modify pricing with 30 days notice. Continued use of the Service after price changes constitutes acceptance.
7. Service Level Agreement
We commit to maintaining service availability as specified in your plan's SLA. Service credits may be issued for downtime exceeding guaranteed uptime levels.
8. Data Processing
By using the Service, you authorize us to process contact data (email addresses, phone numbers) on your behalf for the purpose of OTP verification. You represent that you have obtained necessary consent to process such data.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Afzil and are protected by international copyright, trademark, and other intellectual property laws.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT SHALL AFZIL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify and hold harmless Afzil from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
14. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service constitutes acceptance of the modified Terms.
